General provisions

1. This offer is an official offer of Brynzak Oleksiy Volodymyrovych, Brynzak Volodymyr Mykhailovych, hereinafter referred to as the “Seller”, to conclude a Contract for the purchase and sale of goods remotely, i.e. through the Online Store, hereinafter referred to as the “Agreement”, and places the Public Offer (Offer) on the Seller’s official website “https://www.1ona.store” (hereinafter referred to as the “Website”).

2. The moment of full and unconditional acceptance by the Buyer of the Seller’s offer (acceptance) to conclude an electronic contract for the purchase and sale of goods is considered the fact of payment by the Buyer for the order under the terms of this Agreement, within the terms and at the prices specified on the Seller’s Website.
Concepts and definitions
3. In this offer, unless the context requires otherwise, the following terms have the following meanings:
“goods” - tools, equipment and consumables presented on the online store’s display;
"Online store" - in accordance with the Law of Ukraine "On Electronic Commerce", a means for presenting or selling goods, work or services by means of an electronic transaction.
"Seller" - a company that sells goods presented on the Internet site.
"Buyer" - an individual who has concluded an Agreement with the Seller on the terms set out below.
"Order" - a selection of individual items from the list of goods specified by the Buyer when placing an order and making payment.
Subject of the Agreement
4. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.
This Agreement regulates the purchase and sale of goods in the Online Store, including:

5. voluntary selection by the Buyer of goods in the Online Store;

6. independent registration by the Buyer of an order in the Online Store;

7. payment by the Buyer of an order placed in the Online Store;

8. processing and delivery of the order to the Buyer in the ownership under the terms of this Agreement.
Order placement procedure
9. The Buyer has the right to place an order for any product presented on the Online Store Website and available.

10. Each item can be presented for order in any quantity.

11. In the absence of the product in stock, the Company Manager is obliged to notify the Buyer (by phone or e-mail).

12. In the absence of the product, the Buyer has the right to replace it with an analogue product, refuse this product, cancel the order.
Moment of conclusion of the contract

13. Placing an order is an appeal by the Buyer with an offer to purchase the product. The purchase and sale agreement is considered concluded only after the order is confirmed by the seller

Automatic notifications

14. Automatic notification of receipt of the order is not a confirmation of its acceptance for execution

Order payment procedure
Cash on delivery

15. Payment is made upon receipt of the goods at the branch of the transport companies for cash in hryvnias.

16. If funds are not received, the online store reserves the right to cancel the order.
Payment via the NovaPay system
17. Payment is made on the website at the time of placing the order

18. If funds are not received, the online store reserves the right to cancel the order.
Order delivery terms
19. Delivery of goods purchased in the online store is carried out to the warehouses of transport companies, where orders are issued. Delivery can also be carried out by courier, to the address specified when placing the order.
Rights and obligations of the parties:
20. The Seller has the right:
unilaterally suspend the provision of services under this agreement in the event of the Buyer's violation of the terms of this agreement.
20.1 The Seller checks the possibility of fulfilling the order before its confirmation.

20.2 The Seller has the right to refuse to confirm the order in the event of circumstances that prevent its proper execution.

20.3 The Seller has the right to terminate further contractual relations in cases provided for by law and the terms of the agreement, in particular, in the event of the Buyer committing unlawful acts, abusing rights or disseminating clearly false information. In the event of establishing facts of abuse of consumer rights, submission of unfounded or groundless claims, unfair use of the procedures for returning goods, refunding funds or settling disputes, as well as other actions indicating unfair behavior of the Buyer, the Seller has the right to unilaterally refuse to accept and fulfill future orders of such Buyer and not to conclude new purchase and sale agreements with him, in the manner and within the limits determined by the current legislation of Ukraine.

21 The Buyer is obliged to:
timely pay and receive the order under the terms of this Agreement.
22. The Buyer has the right to:
place an order in the Online Store;
draw up an electronic agreement;
demand from the Seller fulfillment of the terms of this Agreement.
23. The Parties undertake to act in good faith and refrain from abusing their rights. To adhere to the principles of mutual respect and generally accepted standards of business ethics during communication.
24. The Parties undertake to refrain from disseminating knowingly inaccurate information about each other and to act in good faith when exercising their rights.

Liability of the Parties
25. The Parties are liable for failure to fulfill or improper fulfillment of the terms of this Agreement in the manner provided for by this Agreement and the current legislation of Ukraine.

26. The Seller is not liable for:
the appearance of the Goods changed by the manufacturer;
for a minor discrepancy in the color scheme of the Goods, which may differ from the original Goods solely due to different color rendering of personal computer monitors of individual models;
for damage to the Goods resulting from the Buyer's violation of the operating rules, increased mechanical stress, friction, contact with rough surfaces, improper care or other external factors.
for the content and truthfulness of the information provided by the Buyer when placing an order;
for delays and interruptions in the provision of Services (order processing and delivery of goods) occurring for reasons beyond its control;
for unlawful illegal actions committed by the Buyer using this access to the Internet;
- for the transfer by the Buyer of his network identifiers - IP, MAC address,
login and password to third parties;

27. The Buyer, using the access to the Internet provided to him, is independently responsible for the damage caused by his actions (personally,
even if another person was under his login) to persons or their property, legal entities, the state or moral principles of morality.

28. In the event of force majeure, the parties are released from the fulfillment of the terms of this agreement. For the purposes of this Agreement, force majeure circumstances are understood to mean events of an extraordinary, unforeseen nature that exclude or objectively impede the performance of this Agreement, the occurrence of which the Parties could not foresee and prevent by reasonable means.

29. The Parties shall make every effort to resolve any disputes exclusively through negotiations.
Procedure for considering claims

30. When considering an application, the seller has the right to request photographs, video materials, goods for inspection or quality control.

31. The seller has the right to make photo and video recordings of the process of checking the goods, their packaging, shipping and return.

Procedure for returning goods of proper quality
32. The return of goods to the Online Store is carried out in accordance with the current legislation of Ukraine.

33. The return of goods to the Online Store is carried out at the expense of the Buyer.

34. When the Buyer returns the goods of proper quality, the Online Store shall refund the amount paid for the goods upon return of the goods, minus compensation for the Online Store's expenses related to the delivery of the goods to the Buyer.

Other conditions
35. The Online Store reserves the right to unilaterally amend this Agreement subject to its prior publication on the website https://www.1ona.store

36. The Online Store was created to organize a remote method of selling goods via the Internet.

37. The Buyer is responsible for the accuracy of the information specified when placing an order. At the same time, when accepting (placing an order and subsequent payment for the goods), the Buyer gives the Seller his unconditional consent to the collection, processing, storage, and use of his personal data within the meaning of the Law of Ukraine "On the Protection of Personal Data".

38. Payment by the Buyer for an order placed in the Online Store means the Buyer's full consent to the terms of the purchase and sale agreement (public offer)

39. The actual date of the electronic agreement between the parties is the date of acceptance of the terms in accordance with Article 11 of the Law of Ukraine "On Electronic Commerce"

40. Using the Online Store resource to preview the product, as well as to place an order for the Buyer is free of charge.

41. The information provided by the Buyer is confidential. The Online Store uses information about the Buyer solely for the purpose of processing the order, sending messages to the Buyer, delivering the product, making mutual settlements, etc.

42. Before going to court, the parties seek to resolve the dispute through negotiations and a written exchange of positions, using the pre-trial dispute resolution mechanism.
Term of the Agreement
43. An electronic agreement is considered concluded from the moment the person who sent the offer to conclude such an agreement receives a response on acceptance of this offer in the manner specified in Part Six of Article 11 of the Law of Ukraine "On Electronic Commerce".

44. Before the expiration of the term of validity, this Agreement may be terminated by mutual consent of the parties until the actual delivery of the goods by refunding the funds

45. The parties have the right to terminate this agreement unilaterally, in the event of non-fulfillment of the terms of this Agreement by one of the parties and in cases provided for by the current legislation of Ukraine.
